NYC Penalized for Discovery Blunders in LGBTQ+ Fertility Case

New York City will have to pay sanctions for failing to respond to discovery requests in a lawsuit alleging the city’s health plan discriminates against gay male couples by denying them in vitro fertilization benefits.

Any “reasonable expenses and costs, including attorneys’ fees” incurred by the plaintiffs—a former New York City assistant district attorney and his husband—must be paid by the city for its “failures to comply with this Court’s orders” to produce documents, Judge Jeannette A. Vargas of the US District Court for the Southern District of New York said in her Monday order.
