A federal appeals court considered whether a now-defunct nursing home in New Jersey had to bargain with its staffers’ union before reducing and then ending bonus payments made during the early months of the Covid-19 pandemic.
Counsel for Alaris Health at Boulevard East told the US Court of Appeals for the Third Circuit during oral argument Wednesday in Philadelphia that the National Labor Relations Board was wrong to fault the company for not negotiating because its expired contract with the union allowed for such unilateral action on bonuses.
