Two health care staffing companies failed to end a US Labor Department suit alleging their requiring workers to pay a fee for quitting early ran afoul of wage laws.
The DOL has standing to enforce the Fair Labor Standards Act’s minimum wage, overtime, and anti-kickback provisions, the US District Court for the Eastern District of New York said. The agency sufficiently alleged that the damages Advanced Care Staffing LLC and Priority Care Staffing LLC seek from two nurses would violate the wage-and-hour law, according to the Wednesday opinion.
