A nurse from the Philippines who says Advanced Care Staffing LLC trapped him with a contract that imposed steep costs if he quit his job too soon can continue challenging the arrangement in court, the Second Circuit said Thursday.
The nurse “raised sufficiently serious questions” about whether a delegation clause keeps him from vindicating his federal statutory rights, the US Court of Appeals for the Second Circuit said in an unpublished opinion. The panel’s ruling upholds a district court-issued preliminary injunction blocking ACS from moving forward with arbitration proceedings it initiated after the nurse left his job.
