NTT Race Bias Case Based on Crime Data Denied New Appeals Look

A sharply divided Second Circuit rejected calls for the full court to weigh whether a panel properly dismissed, because of a lack of suitable data, a proposed class action alleging NTT Data Inc.'s criminal background check policy illegally screens out Black job seekers.

The request for rehearing en banc was made by George Mandala and Charles Barnett, two Black applicants who had their job offers pulled by the company based on prior criminal convictions.
