A Norfolk Southern Railway Co. train conductor fired after revealing his pre-existing multiple sclerosis diagnosis and related medication use years after being hired can’t prove disability discrimination, the Eastern District of Michigan ruled.

Patrick Garant said he didn’t disclose his MS even though he had been diagnosed 10 years earlier because his doctor told him it was his “personal choice” whether to do so.
