Brentwood Industries isn’t required to rehire a former shift supervisor in Arkansas even though a jury found he was unlawfully fired based on his Mexican national origin, the U.S. Court of Appeals for the Eighth Circuit affirmed (Olivares v. Brentwood Indus., 2016 BL 152949, 8th Cir., No. 15-2674, 5/13/16).
The evidence shows “serious trust issues” exist between Brentwood management and Oscar Olivares stemming from an alleged safety violation by workers under Olivares’s supervision, the court said.
