The National Labor Relations Board’s top lawyer pushed back against state efforts to pick up the slack left by a federal board that’s hamstrung due to its lack of quorum.
State measures that purport to assert jurisdiction over private-sector labor relations disputes would very likely be preempted by federal labor law, NLRB Acting General Counsel William Cowen said in an agency media release Friday.
New York lawmakers in June approved such a bill, which still awaits Gov. Kathy Hochul’s (D) signature. States like California and Massachusetts are also considering similar legislation.
