NLRB Hints at Possible Precedent Change in Union-Ouster Ruling

A Hawaii trucking company violated federal labor law by unilaterally withdrawing recognition from a union without the evidence necessary to show it lost the support of a majority of workers, the National Labor Relations Board ruled.

Kauai Veterans Express Co. offered a petition signed by a majority of union workers as proof that its workforce wanted to reject representation by an International Union of Operating Engineers affiliate. But the petition only showed that those workers didn’t want to be union members, not that they didn’t want union representation, the NLRB said in its Thursday ruling.
