NLRB Halts Mail-Ballot Union Election for Airgas Drivers (1)

The National Labor Relations Board suspended a union election in which Airgas USA drivers at a Texas facility had been slated to vote by mail due to the Covid-19 pandemic.

The Sept. 24 decision marks at least the fourth time since Aug. 25 that the Republican-controlled NLRB granted an employer’s request to halt a mail-ballot election. Lauren McFerran, the board’s sole Democratic member, dissented in those four cases.

That recent spate of NLRB orders pausing union votes by mail signals that the board will reconsider mail-ballot elections if an employer objects.
