NJ Transit Whistleblower Suit’s Dismissal Upheld by Third Cir.

A former locomotive engineer lost a bid to revive her federal lawsuit alleging New Jersey Transit Rail Operations Inc. fired her in retaliation for reporting unsafe practices.

Jodi Asay failed to provide enough evidence that demonstrated the three NJ Transit employees who were involved in her termination knew she had filed a safety complaint, Judge Thomas Hardiman of the US court of Appeals for the Third Circuit said in Thursday’s opinion affirming the district court’s dismissal of the case.
