Ninth Circuit Revisits Jack in the Box Oregon Meal Break Claims

Jack in the Box Inc. workers in Oregon will get another chance to prove the company shortchanged them on pay for interrupted meal breaks, after a federal appeals court reversed its previous ruling on those claims.

A lower court erred in refusing to certify a class and granted the company judgment as a matter of law for the workers’ unpaid break claims, a panel from the US Court of Appeals for the Ninth Circuit decided Monday, amending its own opinion from November.
