California truckers won’t be able to revive on appeal the argument that they should be exempt from a state law making it harder for them to be classified as independent contractors, a divided Ninth Circuit panel said on Monday.

The California Trucking Association asked the U.S. Court of Appeals for the Ninth Circuit to revisit their challenge to the state’s ABC test en banc, but a majority voted against the full court reconsidering the case.
