Nike Subsidiary’s Lawyers Hit With Wage Case Discovery Sanction

Attorneys representing a Nike Inc. subsidiary in a wage dispute are on the hook for sanctions after a federal magistrate judge faulted them for choosing the “nuclear option of simply ignoring” a court deadline.

Nike Retail Services Inc. wasn’t substantially justified in disregarding the order to hand over a class list within two days, the US District Court for the Southern District of California said Wednesday. The court ordered three Sheppard, Mullin, Richter & Hampton LLP lawyers representing Nike Retail to pay the suing plaintiff’s attorneys nearly $4,000. Attorneys for lead plaintiff Adriana Cruz had requested more than $12,000.
