New York Steakhouse Broke Labor Law With New Servers

A New York steakhouse that brought in new workers while its servers and bartenders were on strike committed unfair labor practices, the D.C. Circuit affirmed May 20.

Thirty-six of Sparks Restaurant’s workers went on strike at the end of 2014 when bargaining discussions weren’t progressing after a year and a half. The restaurant brought on new workers to replace them during the 9-day strike.

The National Labor Relations Board didn’t err when it ruled Sparks had violated federal labor laws, the court said in a per curiam opinion. Sparks didn’t produce evidence that it and the new workers mutually understood ...
