New York Repeals Covid-Era Liability Shield for Nursing Homes

New York’s nursing home workers, administrators and executives will no longer be covered under civil liability protections put in place during the coronavirus pandemic, according to legislation signed late Tuesday by Gov. Andrew Cuomo.

The measure (S.5177/A.3397) voids a section of a law known as the “Emergency or Disaster Treatment Protection Act,” which gave temporary immunity to health-care professionals—including hospital and nursing home workers and administrators—related to the injury or death of patients being treated for Covid-19.
