New Jersey Company Ordered to Rehire Workers, Recognize Union

A New Jersey construction company must rehire two workers and bargain with the union seeking to represent them after a National Labor Relations Board judge ruled the company violated federal labor law multiple times.

Administrative Law Judge Kenneth W. Chu issued the rare Gissel bargaining order Monday, demanding that IBN Construction Corp. negotiate with the New Jersey Building Laborers District Council. Chu concluded in the 87-page decision that IBN threatened to fire and sue workers who attempted to unionize, interrogated employees about their union activities, and interfered with an NLRB election during the organizating push in 2021.
