New Jersey Can’t Enforce Sex-Based Job Bias Arbitration Ban

New Jersey can’t enforce a 2019 amendment to its Law Against Discrimination that preserves the right of workers to sue in court to the extent that it would impinge upon employment arbitration agreements governed by the Federal Arbitration Act, a federal judge in Trenton ruled.

The Thursday ruling is a big win for the U.S. Chamber of Commerce, the New Jersey Civil Justice Institute, and members of those groups such as Comcast Corp. and PricewaterhouseCoopers LLP.
