Nestle USA Inc. agreed to pay $254,750 to settle a food production worker’s Fair Labor Standards Act and Ohio wage claims seeking overtime pay for time spent donning and doffing protective clothes and hygiene equipment, according to federal court filings.
The deal allocates roughly $149,000 for individual payments to approximately 900 workers covered by the proposed FLSA collective and Ohio class. Class counsel would get nearly $92,000 for attorneys’ fees and expenses, and lead plaintiff Arnetta Duncan-Watts would receive a $5,000 service award.
