NCR Can Force Arbitration of Job Bias Spat as Successor Employer

A software engineer must arbitrate his age discrimination and other job bias claims against NCR Corp. even though the global technology company wasn’t a party to and never signed an agreement requiring the worker to forego pursuing his claims in court, the District of Nebraska ruled.

NCR can enforce the pact Mark Drazic signed in 2005 as the corporate successor to Retalix USA, the court said Monday. The arbitration agreement listed Drazic and Retalix as the parties, but NCR merged with Retalix in 2002 and Drazic didn’t dispute that NCR has been his employer since that time, the court said. ...
