MyEyeDr Gets Store Managers’ Path Narrowed in Overtime Dispute

Capital Vision Services LLC defeated store managers’ attempt to certify an overtime class, got an employee collective decertified, and convinced a federal judge to grant it a pretrial win on one worker’s claims.

The workers didn’t show that class treatment was the best way to resolve their state-law claims against the optometry chain, which does business as MyEyeDr at more than 500 clinics, the US District Court for the District of Massachusetts said. “Substantially the same reasons” necessitate decertifying the workers’ Fair Labor Standards Act collective, the Thursday opinion said.
