Mixed Bag for CSX in Disability Bias, Retaliation Lawsuit

CSX Transportation, Inc. brought home a partial victory in the case of a diabetic former employee alleging discrimination and retaliation because of his condition.

The U.S. District Court for the Northern District of New York kicked out Robert Matthews’ disability discrimination claim as being filed too late.

But Matthews “sufficiently (though perhaps barely) stated a claim for retaliation,” the court said. The CSX Corp. subsidiary will have to continue defending against that claim.
