Michigan Hospital Wins Sixth Cir. Appeal of Labor Injunction (1)

A federal appeals court nixed an injunction requiring a Michigan hospital to bargain with a union in a decision that deals a blow to the National Labor Relations Board.

The district court was wrong to grant the NLRB’s request for a bargaining order because the agency failed to show that not getting an injunction against Trinity Health Grand Haven Hospital would result in irreparable harm, a divided US Court of Appeals for the Sixth Circuit ruled Friday.
