Miami Heat Wins Arbitration Ruling in Fired VP’s FMLA Suit

The NBA’s Miami Heat LP convinced a federal trial court that an arbitrator must decide whether an arbitration agreement is enforceable in a suit brought by a former attorney for the club who alleges she was fired for taking a leave of absence to adopt a child.

Reference to the American Arbitration Association rules in an arbitration agreement the parties signed when Vered Yakovee was hired is sufficient to require arbitration of the issue of enforceability, the U.S. District Court for the Southern District of Florida said.
