A group of Mexican truck drivers is accusing a California farm labor contractor of deliberately misclassifying them as field laborers in order to avoid paying them the higher prevailing wages required for truckers under the H-2A temporary visa program.
Fresh Harvest Inc. listed the drivers under an H-2A job order for field labor positions or claimed they were employed by an agricultural association rather than a contractor, according to the complaint filed Wednesday in the US District Court for the Northern District of California.
