Metal Company’s Late-Filed Notice of Contest Dismissed

A fabricated metal products company in upstate New York failed to timely file its notice of contest against a citation and therefore the notice is dismissed with prejudice, a Occupational Safety and Health Review Commission judge ruled (Consol. Barricades, Inc. v. Sec’y of Labor, OSHRCJ, 15-1968, 6/6/16).

In an opinion and order released June 6, Judge Dennis L. Phillips granted the Secretary of Labor’s motion to dismiss the notice of contest and denied a motion to dismiss the citation filed by Consolidated Barricade, Inc.
