Meat Processor Loses Appeal of Labor Board Ruling, Remedies

A Nebraska meat processor was unsuccessful in its challenge to a National Labor Relations Board order after a federal appeals court held there was enough evidence that the company failed to bargain with a union in good faith to support the administrative decision.

The US Court of Appeals for the Eighth Circuit on Monday enforced the NLRB’s determination that Noah’s Ark Processors LLC violated federal labor law by negotiating in bad faith and unilaterally imposing a collective bargaining agreement on workers represented by a United Food and Commercial Workers’ Union affiliate.
