First Unum Life Insurance Co. must pay disability benefits to a former McKinsey & Co. employee because she showed a “preponderance of evidence” that she was incapable of working, a New York federal judge ruled.
Judge P. Kevin Castel of the US District Court for the Southern District of New York concluded Friday that the dispute amounted to a difference in opinion between the employee’s medical providers and Unum’s claims reviewers.
The court was allowed to give additional weight to the plaintiff’s case based on factors like the physician’s expertise and the length of the doctor-patient relationship, he said.
