Mayo Clinic and Medica Health Plan Solutions urged a federal court to dismiss a proposed class action that accuses them of failing to provide adequate coverage for out-of-network medical care.
The Mayo employee who brought the suit, identified only as S.M.O, didn’t properly allege violations of the Employee Retirement Income Security Act and federal racketeering law, the companies told the US District Court for the District of Minnesota. S.M.O. claims she was billed more than expected after her child received mental health care from an out-of-network medical provider.
