Call center operator Maximus Inc. failed to convince the US Supreme Court to temporarily pause an appeals court order that refused to adopt a heightened standard for conditionally certifying collective actions in wage and hour cases.
Chief Justice John Roberts on Thursday declined to stay a July decision from the US Court of Appeals for the Fourth Circuit certifying a Fair Labor Standards Act collective action accusing Maximus of unlawfully denying current and former call center workers overtime pay.
More than 10,000 current and former workers could join as plaintiffs in light of the order.
