Maryland Radiation Therapist Loses Whistleblower Firing Suit

A radiation therapist lost a bid to revive her claims that she was fired by RadAmerica II LLC for whistleblowing, after the Maryland Supreme Court ruled that she failed to show she wouldn’t have been fired “but for” her disclosure.

The Maryland Health Care Worker Whistleblower Protection Act requires that a plaintiff must prove the employer wouldn’t have taken the adverse personnel action but for the protected disclosure, the court said in an opinion by Justice Steven B. Gould.
