Marley-Wylain Co. Gets Retrial in $5.4 Million Asbestos Ruling

Marley-Wylain Co. convinced a California appeals court to vacate a $5.4 million asbestos liability award on the basis that a Los Angeles jury should have been instructed on causation under Michigan law, rather than California law.

Robert Swanson alleged he was exposed to asbestos while working with boilers made by Weil-McLain Co. Inc., now a division of Marley-Wylain, in Michigan. After being diagnosed with cancer in 2014, he sued Marley-Wylian in California.

The California Court of Appeal, Second District, ordered that Michigan law be applied to all of Swanson’s claims, because his alleged exposure to asbestos in Marley-Wylain products occurred ...
