Marijuana Business Seeks Full 10th Cir. Review in Overtime Case

A Colorado marijuana business wants the full Tenth Circuit to reconsider whether marijuana workers are covered by the Fair Labor Standards Act, even though their work violates federal drug laws.

A three-judge panel of the U.S. Court of Appeals for the Tenth Circuit recently ruled that employers in the marijuana industry aren’t excused from complying with the FLSA’s overtime rules simply because their business practices are federally prohibited.
