Mar-Jac Loses Appeal Over OSHA Citation After Worker’s Death (1)

The Fifth Circuit upheld an OSHA citation against poultry processor Mar-Jac MC LLC, finding that the company didn’t prevent known hazards for an eviscerator machine that cuts chickens and was involved in the death of a worker.

The appeals court’s Thursday denial of review affirms an Occupational Safety and Health Review Commission decision regarding the application of machine guarding and safety instruction signs standards. The US Court of Appeals for the Fifth Circuit’s decision brings clarity to when employers should protect workers based on daily common practices and not just rely on safety training to meet those requirements.
