A former federal inmate suing the government after the US Probation Office failed to correct a presentence investigation report that mistakenly identified him as a double murderer won an appeal to revive one of his claims Wednesday.
The US Court of Appeals for the Third Circuit reversed the district court’s dismissal of the Federal Tort Claims Act allegation in Rocky Freeman’s suit. Among other things, dismissal for lack of an actionable claim was premature, the appeals court said.
