Macy’s Set To Win Arbitration Bid in Manager’s Wage, Breaks Suit

Macy’s Inc. should be allowed to enforce an arbitration pact in a California labor suit alleging the retailer misclassified hundreds of store managers in the state as exempt from certain wage and breaks rules, a federal magistrate judge said.

Plaintiff Brian Pitman signed a valid agreement to individually arbitrate these kind of claims through Macy’s internal dispute resolution process, Magistrate Judge Barbara A. McAuliffe of the U.S. District Court for the Eastern District of California said Thursday. The court recommended Macy’s motion to compel arbitration be granted.
