Macy’s $3.5 Million Driver Misclassification Deal Gets First OK

A $3.5 million settlement between Macy’s West Stores Inc., a third-party logistics company, and a class of delivery drivers and helpers who said they were misclassified as independent contractors got a tentative green light from a California federal judge Oct. 30.

Logistics company XPO Last Mile Inc. agreed to pay the amount on behalf of itself and Macy’s, with the defendants denying any liability or wrongdoing in connection with the claims. The plaintiffs asserted claims for unpaid wages, minimum wages, overtime pay, and more, making the deal similar to others struck with Macy’s over allegations of misclassification.
