Lyft Again Loses PAGA Arbitration Claim in California Court (1)

Lyft Inc. cannot force a worker to arbitrate labor claims on behalf of other workers under a unique California law, but his individual claims must be arbitrated, a state appeals court said Thursday in a break from the US Supreme Court’s view.

“We conclude that we are not bound by the analysis of PAGA standing set forth in Viking River. As Justice Sotomayor recognized in her concurring opinion, PAGA standing is a matter of state law that must be decided by California courts,” Associate Justice Audrey B. Collins wrote for the California Court of Appeal, Second District.
