Lufthansa Caterer Ducks Worker’s Privacy Claims (Corrected)

Sky Chefs Inc., a Lufthansa-owned airline caterer, won its bid to dismiss a former employee’s claims that it violated Illinois’s Biometric Information Privacy Act, but it must still face his overtime allegations, a federal court in Illinois ruled Monday.

The BIPA claims are preempted by the Railway Labor Act because they implicate the terms of a labor contract between an air carrier and a union, Judge Matthew F. Kennelly of the U.S. District Court for the Northern District of Illinois said, partially granting Sky Chef’s motion to dismiss.
