Older Lowe’s Workers Suing Over Pay Change Certified as Class

Lowe’s Home Centers LLC workers alleging age bias in the retailer’s decision to end its commission-like payments to sales associates can pursue the suit as a class action, the Middle District of Florida ruled.

Diane Bartholomew and Michael Sherry met the “lenient standard” for conditional certification of a collective action under the Age Discrimination in Employment Act, the court said.

Lowe’s didn’t dispute the proposed class would include other workers similarly situated to Bartholomew and Sherry in their allegations that age discrimination drove the pay change, the court said.
