L’Oréal Wins Partial Dismissal of Discrimination, Overtime Suit

L’Oréal won its bid to partially dismiss a Fair Labor Standards Act lawsuit, after the US District Court for the Southern District of New York said the former employee’s claims for unpaid overtime wages were both too vague and too late.

Plaintiff Raphael Sanchez’s claims are based on his work as a makeup artist and skincare consultant for L’Oréal in 2018, but he didn’t file his lawsuit until 2021.

The FLSA has a two-year statute of limitations for unpaid overtime claims, which is extended to three years for willful violations of the law, but boilerplate allegations won’t suffice to trigger ...
