American Eagle Express Inc. courier drivers may move forward with their unlawful deductions claim as a class, but not their unjust enrichment and unpaid overtime claims, a federal judge in New Jersey said.
The couriers accuse the logistics firm, known as AEX, of misclassifying them as independent contractors and thus withholding wages due to them as employees under New Jersey law. They meet class certification requirements for one of their claims, but not the others, the US District Court for the District of New Jersey said in an unpublished opinion.
