Limits on Giving Unions the Heave-Ho Face Legal Challenge (1)

A conservative advocacy group sued the National Labor Relations Board to challenge its rule limiting when workers can try to vote out a union following a settlement agreement that requires bargaining.

The National Right to Work Legal Defense Foundation said in its Nov. 27 lawsuit that the NLRB’s “settlement bar” doctrine violates workers’ rights under federal labor law. A settlement agreement between an employer and a union can’t eliminate the NLRB’s obligation to process petitions claiming a union no longer commands support from a majority of workers, the foundation said.
