Lawn Service Company Challenges DOL Judge Power Over H-2B Fines

A libertarian legal group has launched a second constitutional challenge against the US Labor Department’s internal adjudication process, arguing in federal court that the agency lacks authority to issue fines against a Maryland landscaping company.

CS Lawn & Landscaping argued in a complaint filed in the US District Court for the District of Columbia that a $55,000 fine levied over violations of the agency’s H-2B visa program for non-farm seasonal workers should be invalidated because it violates the US Constitution—including the Seventh Amendment’s right to a trial by jury, Article III, and the Excessive Fines Clause of the Eighth Amendment. ...
