A Birmingham-based salesman can’t advance proposed class claims that Lamar Advertising Co.'s unwritten practice of withholding commissions when clients paid more than 90 days late breached his contract, an Alabama federal court ruled.
The practice became part of Bryan Hughes’ at-will employment agreement because he knew about the practice and continued working for Lamar anyway, Judge Karon Owen Bowdre of the U.S. District Court for the Northern District of Alabama said Wednesday.
