Lactating Worker May Not Have Settled Her Job Bias Claims

A Texas woman can pursue a lawsuit alleging her employer discriminated and retaliated against her when she returned from maternity leave and took lactation breaks, a federal judge ruled.

Arbor E&T LLC failed to show Shaunice Pattillo’s pregnancy discrimination and retaliation claims under Title VII of the 1964 Civil Rights Act were covered by an agreement she entered with the company settling separate claims she raised under the Fair Labor Standards Act, the U.S. District Court for the Northern District of Texas said April 3.
