Labor Department Nabs Partial Win in Home Health Firm Wage Row

The US Labor Department demonstrated that a Maryland home health company owes its aides overtime and minimum wage because those workers were employees and not independent contractors, a federal judge said.

The DOL provided undisputed evidence showing Jerry’s Caring Hands Inc. had an employer-employee relationship with the home health aides, meaning they fall under the protection of the Fair Labor Standards Act’s minimum wage and overtime requirements, Judge Julie R. Rubin of the US District Court for the District of Maryland said Friday. However, she said DOL didn’t show the same is true for Jerry’s licensed practical nurses.
