The US Labor Department convinced a federal judge to throw out the claims of one of a trio of home-care firms challenging a revision to an agency rule on overtime exemptions.
The companies sought to block the DOL’s revised regulation after the agency started investigating their alleged wage violations but before it sued them. The DOL enforcement action against Americare Home Healthcare Services LLC is too advanced to allow separate claims in this case, but the other two firms can continue seeking declaratory judgment, the US District Court for the Western District of Pennsylvania said Thursday.
