Labor Department Dumps Trump Guidance Rule for ‘Flexibility’

The Biden administration-led U.S. Labor Department withdrew a measure by its predecessors designed to give the public fairer notice of interpretive guidance, labeling it a threat to delay the agency’s ability to tackle urgent national problems.

The Trump administration rule “deprives the Department ... of necessary flexibility in determining when and how best to issue public guidance ... and unduly restricts the Department’s ability to provide timely guidance on which the public can confidently rely,” the Biden DOL stated in the rescission.
