Labor Board’s Expanded Remedies Get Little 5th Cir. Attention

A federal appeals court partially overturned an NLRB decision that increased the agency’s ability to order employers to pay workers for the economic consequences of their illegal conduct, but motly sidestepped the propriety of that board power in favor of focusing on the facts of the case.

The US Court of Appeals for the Fifth Circuit held Friday that the National Labor Relations Board was wrong to rule that Thryv Inc., a marketing and software company that sells Yellow Pages advertising, violated federal labor law by laying off six workers.
